Car Parking in a Bangalore Apartment: What a Builder Can and Cannot Sell

Car parking is one of the most common extra lines on a Bangalore flat cost sheet, often Rs. 1 Lakh or more for one bay. The law draws a clear line between parking a builder may allot and parking it may sell as property. This guide covers each kind of bay (open, stilt, basement, garage and visitor), what the Supreme Court and the RERA Act say, and what to get in writing before paying.
Why Parking Is a Separate Line on the Cost Sheet
Parking is scarce in most apartment projects, and a bay close to the lift is worth a lot to an owner. Showing parking as an add-on also lets a developer quote a lower flat price in its adverts. As a result, many cost sheets list "car parking charges" next to clubhouse fees and deposits.
The charge itself is not always unlawful, but what it pays for matters. A builder may recover the cost of building parking through the price of the home. Selling an uncovered or stilt bay to one buyer as a piece of property is a different matter.
What the Supreme Court Decided
The leading ruling is the Nahalchand Laloochand case of 2010, in which the Supreme Court looked at stilt bays in a housing society. In its view, a stilt bay forms one of the shared facilities of the building. Since it is neither a flat nor a garage, the promoter has no power to sell it on its own.
The case arose under the Maharashtra flat ownership law, but its reasoning on common areas is cited across the country. In effect, stilt bays pass to the owners collectively at handover. The builder retains no separate right to sell them.
What the RERA Act Says
The central RERA law of 2016 applies in Karnataka through the Karnataka RERA authority. Two of its definitions decide the parking question. The first, the meaning of "common areas", names open parking expressly, next to basements, terraces, parks and play areas.
The second is the meaning of "garage": a roofed place enclosed on three sides by walls, used to park a vehicle. Unenclosed or uncovered spaces, such as open parking, are left out of it. A true garage that is also marked on the approved plan may be sold to a buyer as its own unit.
Parking Types at a Glance
The position of each kind of parking under these rules is set out below.
| Parking type | Status | Who controls it after handover |
|---|---|---|
| Open parking in the compound | Common area, so sale is barred | The owners' association |
| Stilt parking under the building | Common area under the 2010 ruling, so sale is barred | The owners' association |
| Enclosed garage marked on the approved plan | May be sold as its own unit | The owner who bought it |
| Visitor parking | Reserved for guests, so sale is barred | The owners' association |
Basement and podium bays fall in a grey area, since most are covered but not enclosed by walls. The safe course is to treat them as an allotment that must be recorded in writing, rather than a piece of property bought outright.
How Allotment Works in a Bangalore Apartment
Most Bangalore projects allot a numbered bay to each home through the sale agreement or an allotment letter. In a well-run project, the approved plan and the RERA filings both show where every bay is. The bay number then follows the home through the sale deed.
Apartments in Karnataka are also governed by the Karnataka Apartment Ownership Act, 1972. Under it, the builder records a deed of declaration that lists the common areas and any limited common areas reserved for particular homes. Parking bays tied to specific homes are often shown there, which makes the allotment binding on the association later.
Disputes tend to appear at handover, when the owners' association takes charge of the common areas. A bay promised only in a brochure or a message carries little weight then. A bay named by number in the agreement, the deed of declaration and the sale deed is far easier to defend.
What to Get in Writing
A few clear documents settle almost every parking question later. Before paying any parking amount, ask for these:
- The approved parking drawing, with the total bays and the visitor bays marked
- The bay number allotted to the home, written into the agreement for sale
- The type of bay: open, stilt, basement, mechanical or enclosed garage
- How the parking charge is described on the cost sheet and the receipt
- For a mechanical or stack bay, who bears the repair and running costs
- The deed of declaration showing the bay as allotted to the home
For a family with two cars, the second bay needs the same care. Many projects allot one bay per home by default and offer a second only on request.
If a Common-Area Bay Was Sold to You
A buyer who paid a sale price for an uncovered or stilt bay may file a complaint with the Karnataka RERA authority. The complaint is made online, against the project's registration, with the cost sheet, receipts and agreement attached. The authority may order a refund with interest where it finds the charge was not lawful.
Leverage is strongest before the agreement is signed. Raising the point before signing often leads the builder to merge the charge with the flat price, or to document the bay properly. A property lawyer can review the parking clauses along with the rest of the agreement.
Parking and the Total Cost of a Home
Parking is one of several charges that come on top of the base price, along with GST, clubhouse fees, deposits, stamp duty and registration. In Karnataka, stamp duty is 5% for a home priced over Rs. 45 Lakhs, which becomes 5.6% with cess and surcharge, and the registration fee is 2%. When comparing new apartments in Bangalore, compare the full cost sheet rather than the headline price.
