Buying property in India as an NRI

Many Non-Resident Indians want a home back in Bangalore, for their family, for their return, or as an investment. Buying from abroad raises practical questions: which project to trust, how to see it, how to pay, and how to handle the paperwork without flying down each time.

Can an NRI buy property in India?

Yes. Under India's foreign exchange rules, NRIs and OCI cardholders can buy residential and commercial property in India without any special permission. There is no limit on the number of homes you can buy.

What NRIs cannot buy is agricultural land, a plantation property or a farmhouse, unless it comes to them by inheritance. The payment must come through normal banking channels, such as your NRE, NRO or FCNR account, or money sent from abroad.

NRI home loans

Indian banks and housing finance companies give home loans to NRIs, much like they do to residents. The loan is usually repaid from your NRE or NRO account, and the bank looks at your income abroad, your job and your credit history.

You will typically need your passport and visa or work permit, proof of overseas income, bank statements, and the property documents. Our EMI calculator shows what a loan will cost each month before you speak to a bank.

Registering without flying down

You can give a Power of Attorney to a family member or someone you trust in India, so they can sign and register on your behalf. A Power of Attorney signed abroad usually needs to be attested at the Indian embassy or consulate, and stamped once it reaches India.

We can guide your representative through the registration. For the legal wording of the Power of Attorney, please take advice from a lawyer.

Things to check before you buy

  • The project's RERA registration and its possession date on the RERA website.
  • The developer's record of delivering past projects on time.
  • How and when you pay: the payment plan, and which account the money comes from.
  • Your tax position in India and abroad. Rental income and sale gains in India can be taxed here, so speak to a tax adviser.

If you sell later, NRIs can usually send the sale money of up to two homes back abroad, within the rules. Your bank can explain the steps when the time comes.
