Getting Property Documents Back After Closing a Home Loan: The RBI 30-Day Rule

A lender keeps the original sale deed and other title papers for as long as a home loan runs. Since 1 December 2023, a Reserve Bank of India (RBI) rule has fixed how quickly those papers must come back once the loan is repaid. This guide explains the 30-day rule, the compensation for delay, and the steps a Bangalore borrower should follow at closure.
What the RBI Rule Says
The RBI set out the rule in a circular dated 13 September 2023. Once a loan is repaid in full or settled, the lender has 30 days to hand back every original document it holds, for movable and immovable property alike. Any charge it registered over the property must be cleared within the same 30 days.
The rule covers every case where the papers became due for return from 1 December 2023 onwards. The date the loan was taken does not matter, so a loan sanctioned in 2010 and closed in 2026 is covered.
Loans and Lenders Covered
The rule covers personal loans as the RBI defines them, and that definition includes home loans. The directions bind these types of lender:
- Commercial banks, including small finance banks and regional rural banks
- Urban, state and district co-operative banks
- NBFCs, including housing finance companies
- Asset reconstruction companies
Almost every lender that a home buyer in Bangalore deals with is therefore covered. The protection comes from regulation, so it applies even where the loan agreement is silent on it.
The Two Parts of a Release
A proper closure has two parts, and both fall under the 30-day limit. The first is the return of the papers. The second is the removal of the lender's charge from the public record.
Return of the original papers
The lender returns everything it took as security at the time of the loan. The list of documents given at disbursement is the reference, and each paper should be ticked off against it. A typical file for a flat holds these papers:
- The registered sale deed, and the sale agreement for a flat bought under construction
- Earlier title deeds, where the home was bought on resale
- The possession letter and the allotment letter
- Original payment receipts and the builder's no-objection certificate
- The share certificate or association papers, where they were deposited
Removal of the charge
Most home loans in Karnataka are secured by a deposit of title deeds, recorded at the sub-registrar's office through a memorandum. The lender's claim also appears on CERSAI, the central registry of security interests. After closure, the mortgage should be discharged at the sub-registrar's office and the CERSAI entry marked as satisfied.
An uncleared charge makes a fully paid home look mortgaged. It shows in the encumbrance certificate and can hold up a later sale or a new mortgage.
Where the Documents Are Collected
The borrower chooses the place of collection. The papers may be taken at the home branch of the loan account or at another of the lender's offices that holds them. This helps a borrower who took the loan in one part of the city and has since moved.
Every sanction letter dated 1 December 2023 or later must state when and where the documents will be returned. A borrower with a newer loan should check the sanction letter for these terms.
Compensation for Delay
A lender that crosses the 30-day limit must explain to the borrower why. Where the lender is responsible for the delay, it owes the borrower Rs. 5,000 a day until the papers are released. The same compensation applies when the lender is late in filing to clear its charge.
The payment does not replace the borrower's other legal rights. A complaint to the lender's grievance officer comes first. A complaint against a bank or an NBFC that stays unresolved for 30 days can be taken to the RBI Ombudsman. For a housing finance company, the next level is the National Housing Bank.
Lost or Damaged Documents
Papers do get misplaced in central storage. Where some or all of the original papers are lost or damaged, the lender must help the borrower get duplicates or certified copies. The lender bears the cost of doing so.
In such a case the lender gets 30 more days to complete the work, so the daily compensation starts on day 61. A certified copy of a registered deed comes from the sub-registrar's office where the deed was registered. Borrowers should keep scanned copies of every paper handed to the lender.
When the Borrower Has Died
The directions also cover the death of a sole borrower or of joint borrowers. Every lender must have a set procedure for returning the original documents to the legal heirs. The procedure must be displayed on the lender's website with its other customer policies.
Steps to Close a Home Loan Cleanly
A closure goes smoothly when the borrower treats it as a process with dates. These steps keep the 30-day count clear:
- Ask the lender for a written foreclosure or closure statement and pay the exact amount shown.
- Collect a receipt for the final payment and note the date, since the 30 days run from it.
- Give a written request for the original documents and name the branch for collection.
- Check each returned paper against the list of documents issued at disbursement.
- Collect the no-dues certificate, which states that the loan is closed and nothing is owed.
- Confirm that the mortgage is discharged at the sub-registrar's office and on CERSAI.
- Apply for a fresh encumbrance certificate and see that the lender's entry is closed.
- Check the credit report after a month or two to see the loan marked as closed.
