Sub-Registrar Jurisdiction and Anywhere Registration in Bangalore

A sale deed for a home in Bangalore has to be registered at an office that has authority over the property, and within a fixed time after signing. This guide explains how sub-registrar jurisdiction works under the Registration Act, 1908 and how far Karnataka's anywhere registration facility widens the choice. It also covers the four-month deadline and the people who must appear before the registering officer.

The Basic Rule: The Property Decides the Office

Section 28 of the Registration Act, 1908 fixes the place of registration for any document about land or buildings. The deed is presented at the office of a sub-registrar within whose sub-district the whole property, or some part of it, is located. The buyer's home address, the seller's address and the place where the deed was signed play no part.

Each sub-registrar office in Karnataka covers a defined list of villages, wards and survey numbers. A flat in Whitefield therefore belongs to the office that serves that part of East Bangalore, even when both parties live in the south of the city. The rule keeps the public record of a property in one predictable place, so that a later buyer or a bank finds every past deed in a single search.

Anywhere Registration in Karnataka

Karnataka relaxes the basic rule through its anywhere registration facility. Under it, a deed may be registered at any sub-registrar office within the registration district in which the property is located. The facility ran for several years in the Bangalore registration districts and was extended across Karnataka from 2 September 2024.

The aim is to spread the load. A buyer whose home office is booked for days may choose a quieter office in the same district and register sooner. The record still reaches the correct index, because all offices work on the same Kaveri 2.0 system.

The limit: the registration district

The choice ends at the boundary of the registration district. Bangalore is divided into five of them, named after their headquarters: Basavanagudi, Gandhinagar, Jayanagar, Rajajinagar and Shivajinagar. Each district holds several sub-registrar offices, and a deed for a property in one district cannot be taken to an office in another.

How to find the offices open to a property

The Kaveri 2.0 portal settles the question during the application. Once the property is entered by its e-khata or survey number, the system ties the transaction to the correct registration district. The offices shown at the slot booking stage are the ones permitted for that deed.

The portal's own list is more dependable than advice from another buyer, because jurisdiction lists are revised when new offices open. Our guide to Kaveri 2.0 slot booking explains the online steps in order. A buyer who is unsure may also confirm the district with the home sub-registrar office before paying the charges.

The Four-Month Deadline

Section 23 of the Registration Act gives four months from the date of execution to present a document for registration. Execution means signing, so the clock starts on the day the parties sign the sale deed. A will is the one common exception, and it may be presented at any time.

The dates below matter for a sale deed:

  • Within four months of signing: the deed is presented in the normal way, with stamp duty and the registration fee
  • Up to four more months: the District Registrar may accept the delay under section 25, on proof of urgent necessity or unavoidable accident, with a fine of up to ten times the registration fee
  • After that: the deed cannot be registered, and the parties have to sign a fresh one
  • Signed outside India: a deed executed abroad may be presented within four months of its arrival in India, under section 26

In practice the Kaveri 2.0 process leaves little room for delay, because the deed is signed and registered at the same appointment. The deadline matters most when a deed was signed earlier on stamp paper, or when one party signed abroad. A sale of immovable property worth Rs. 100 or more must be registered under section 17. An unregistered sale deed does not transfer ownership.

Who Must Appear at the Office

Section 32 lists the people who may present a deed, and section 34 requires the persons who executed it to appear before the registering officer. For a sale, that means every seller and every buyer named in the deed. The officer confirms each person's identity and that the deed was signed willingly, which is the main safeguard against impersonation.

A person who cannot attend may act through an agent holding a power of attorney. Section 33 sets the conditions for it to be accepted:

  • A principal living in India executes the power of attorney before the Registrar or Sub-Registrar of the area where he or she resides, who authenticates it
  • A principal living abroad executes it before a notary public, a court or an Indian consular officer, and has it stamped in India after it arrives
  • The power of attorney must cover the specific act, such as presenting the deed and admitting execution

NRI buyers and sellers use the second route most often. Section 31 also allows a registering officer to attend at a private residence on special cause, such as serious illness. Our NRI page has more on buying from abroad.

When the Office Has No Jurisdiction

A sub-registrar may refuse a deed for a property outside the area the office is allowed to serve. Kaveri 2.0 blocks most such cases before they reach the counter, since a slot is offered only at a permitted office. The usual result of a wrong assumption is therefore a lost day and a new booking.

Older paper-era deeds deserve a closer look in a resale. A deed registered at an office that had no authority over the property is open to challenge. Courts have treated the device of adding a token property to gain jurisdiction as a fraud on the registration law. The title lawyer should confirm that each deed in the chain was registered at a proper office.

Checks Before Booking a Slot

A few minutes of checking before the booking saves a wasted appointment. These points cover the common faults:

  1. Note the village or ward, the survey number or e-khata number, and the home sub-registrar office from the seller's earlier deed
  2. Confirm the registration district, and shortlist offices only within it
  3. Agree a date when every buyer and seller is in the city, or arrange an authenticated power of attorney well ahead
  4. Keep the signing and the registration on the same day, well inside the four-month limit
  5. Work out the stamp duty and the 2% registration fee in advance, since the appointment cannot go ahead with a shortfall

Stamp duty in Karnataka is 5% above Rs. 45 Lakhs, which becomes 5.6% with cess and surcharge. Our EMI calculator shows these upfront costs for any price. After registration, the buyer collects the registered deed and applies for the khata transfer in the same name.
