Occupancy Certificate in Bangalore: Why It Comes Before Possession

An occupancy certificate is the paper that makes a finished apartment tower lawful to live in, and in Bangalore it should arrive before the keys do. This guide explains who issues the certificate, how it differs from other completion papers and what the RERA Act says about it. It then covers the cost of moving in early and the way to verify a certificate that a developer produces.
What the certificate confirms
Every building starts with a sanctioned plan. When construction ends, the authority that sanctioned the plan inspects the building and compares it with what was approved. If the floors, setbacks, height, parking and fire safety measures match, it issues the occupancy certificate, usually shortened to OC.
Within Greater Bengaluru the city corporations issue the certificate, and the Bangalore Development Authority does so for plans it has approved. On the outskirts the job falls to the planning authority or the local body that sanctioned the plan. Large towers also need clearances from the fire department and other agencies before the OC is granted.
The certificate speaks about compliance with the plan. It is not a statement about the quality of the tiles, the plumbing or the paint, and it does not prove ownership. Those questions are answered by the handover inspection and the title deeds.
OC and the papers it is confused with
Four documents appear around the time a project finishes, and their names sound alike. The table below separates them.
| Document | Issued by | What it means |
|---|---|---|
| Commencement certificate | Plan-sanctioning authority | Permission to continue building after the foundation is checked |
| Completion certificate | Plan-sanctioning authority | The building work is finished as per the plan |
| Occupancy certificate | Plan-sanctioning authority | The finished building may be occupied |
| Possession letter | Developer | The developer hands the flat to the buyer on a stated date |
In Bangalore the letters "CC" usually refer to the commencement certificate, which comes early in construction. A possession letter is a private document between the developer and the buyer. It carries no approval from any authority, however official it looks.
Partial occupancy certificates
A large project is often certified in parts, tower by tower or phase by phase. A partial OC is valid for the blocks and floors it names and for nothing else. A buyer in Tower C gains nothing from a certificate that lists Towers A and B.
What the RERA Act requires
The Real Estate (Regulation and Development) Act, 2016 ties handover to the certificate at three points. Together they leave little room for possession without an OC in a registered project.
- Section 11(4)(b) makes the developer responsible for obtaining the completion or occupancy certificate and giving it to the buyers or their association
- Section 17 requires the conveyance deed and physical possession within three months of the occupancy certificate, unless a local law says otherwise
- Section 19(10) requires the buyer to take physical possession within two months of the occupancy certificate
The model agreement for sale follows the same order. The developer offers possession in writing after obtaining the certificate, and the buyer's duty to take the flat and pay maintenance begins from that offer. An offer made before the OC is granted does not start that clock.
What moving in early costs
Developers running late sometimes invite buyers to take the keys "for interiors" or to move in while the certificate is awaited. The request sounds harmless, and the effects show up over the following months.
- Utilities: the Supreme Court ruled in December 2024 that power, water and sewerage connections should go only to buildings with a completion or occupancy certificate
- Khata: the flat may fail to get a regular khata in the buyer's name until the building is certified
- Loans: lenders ask for the OC before the final disbursement and when a later buyer applies for a loan
- Resale: an informed buyer or the buyer's bank will ask for the certificate first
- Delay claim: accepting possession weakens the argument that the flat was still undelivered
- Safety: lifts, fire systems and sewage treatment may still be untested
A tower without an OC often runs on a temporary power connection billed at a higher tariff and on tanker water. Those costs reach residents through the maintenance bill. The civic body is also entitled to act against occupation of an uncertified building.
Why a certificate gets held up
The common reasons are an extra floor or extra flats beyond the plan, setbacks that fall short and parking converted to other uses. Unpaid fees and pending clearances from the fire, pollution or water agencies also stall it. Some of these are cured in weeks, and a deviation in the structure itself may never be cured.
The exemption for small houses
In September 2025 the state exempted small residential buildings in Greater Bengaluru from the occupancy certificate. The order covered plots of up to 1,200 sq ft with ground plus two floors or stilt plus three. A further order in June 2026 widened the relief to plots of up to 2,400 sq ft.
The relief is meant for houses built on individual sites, and a sanctioned plan is still required for them. Apartment projects sold by developers remain outside it. A buyer of a flat in a tower should therefore expect the certificate in every case.
How to verify an occupancy certificate
A photocopy handed over at the sales office deserves a second look. The checks below take an afternoon.
- Read the issuing authority, the certificate number and the date
- Match the survey number, the address and the plan sanction number with the agreement for sale
- Confirm that the tower, the wing and the floor of the flat are named in it
- Count the floors and flats it covers against the building as built
- Look at the project's page on the Karnataka RERA portal, where completion papers are uploaded
- Ask the issuing office to confirm the certificate, directly or through a lawyer
Read the conditions printed on the certificate too. Some are issued subject to work that the developer must still finish, such as a sewage treatment plant or a rainwater system. The owners' association will inherit those items if they are left open.
What to do when possession is offered without it
Reply in writing that possession will be taken once the certificate is granted, and ask for the date of the application. Keep paying only the instalments that have fallen due under the agreement. The final instalment is normally linked to possession, so it waits as well.
While the agreed date has passed, interest for the delay keeps running under Section 18 of the Act until a valid offer of possession. A buyer who needs to shift for practical reasons should take a lawyer's advice and record in writing that no claim is given up. Where the developer stays silent for months, a complaint to the Karnataka Real Estate Regulatory Authority is the next step.
For a resale flat in an older building, ask the seller for the OC along with the title deeds and the khata. Our team checks the completion status of the projects we list, and the contact page is the way to ask about one.
