Stamp Duty Refund in Karnataka When a Property Deal Is Cancelled

A property deal in Bangalore sometimes falls through after the stamp duty has been paid. The Karnataka Stamp Act, 1957 allows part of that money to be claimed back, within fixed time limits and after a deduction. This guide explains which payments qualify, how much comes back, where the application goes, and when the claim lies against the builder instead.

Which Payment Is Being Claimed

The answer depends on the document that was stamped. A buyer may have paid duty at one of three stages, and the refund position differs at each:

  • Agreement for sale without possession. The duty is small, a fraction of the duty on a sale deed.
  • Sale deed stamped but not registered. The full duty, 5% above Rs. 45 Lakhs plus cess and surcharge, has been paid.
  • Sale deed registered. The transfer is complete in law, and the refund provisions no longer help.

Most bookings of under-construction flats stop at the first stage. The duty on the agreement is also adjusted against the duty on the sale deed when the deed follows between the same parties. The large amounts are at stake at the second stage, when the duty for the deed is paid and the deal collapses before registration.

What the Stamp Act Allows

Chapter V of the Act deals with allowances for stamps. It treats a stamped document that fails as a "spoiled" stamp and sets out the cases that qualify. Three provisions matter to a property buyer.

A Document That Was Never Signed or Completed

Section 47 covers a document that was written out and stamped but never signed by any party. It also covers a signed document that cannot be completed because a necessary party refuses to sign or has died. A sale deed the seller refuses to execute falls in this group.

A Signed Document That Fails Its Purpose

The same section covers a signed document that totally fails because a party refuses to act under it. It also covers a document later found void from the beginning, or unfit for its purpose because of a mistake. Two conditions apply to every signed document: no court case that relies on it has begun, and the original is surrendered for cancellation.

Stamps Bought and Not Used

Section 52 covers stamps that were bought in good faith and are no longer needed. The buyer must have paid the full price and must surrender the stamps for cancellation. The stamps must have been bought within one year before the date of surrender.

Time Limits and Deductions

The time limits are short, and a late claim is the most common reason for losing the money. The table shows the period and the deduction for each case.

CaseApply withinDeduction
Signed document that fails because a party refuses to act under itSix months of the date of the document20 paise per rupee
Other signed documents covered by Section 47One year of the date of the document20 paise per rupee
Stamped paper with no signed documentOne year after the stamp is spoiled20 paise per rupee
Unused stamps under Section 52One year of purchase10 paise per rupee

The deduction is a real cost on a large payment. On stamp duty of Rs. 5 Lakhs, a 10% deduction leaves Rs. 4.5 Lakhs, and a 20% deduction leaves Rs. 4 Lakhs. The clock runs from the date of the document or the purchase of the stamp, and the date of cancellation does not reset it.

Relief After the Time Limit

Section 52A gives the State Government the power to grant relief in cases that fall outside these sections or outside their time limits. The relief is discretionary, and the terms are set by government order. A buyer who has missed the deadline may still apply, with the reasons for the delay set out in full.

A Karnataka High Court case shows how this works. A buyer paid stamp duty of Rs. 10,51,875 and a registration fee of Rs. 1,23,750 on a sale deed dated 30 September 2008. A title problem surfaced, and he withdrew the document in November 2009.

He asked for both amounts in full, and the court refused. The stamp duty came back less 25 paise per rupee under a government order issued under Section 52A, and the registration rules allowed half the registration fee.

How to Apply

The application goes to the officer the Act calls the Deputy Commissioner for stamps, a role held in the registration department by the District Registrar. The office that covers the place where the stamp was bought or the document was presented is the right one. These papers are normally needed:

  • A written application that states why the document was not used or completed.
  • The original stamped document or stamp certificate, surrendered for cancellation.
  • Proof of payment of the duty, such as the challan or payment receipt.
  • Proof that the deal ended, such as the cancellation letter or the other party's written refusal.
  • Identity proof, PAN and bank account details of the person who paid.

An order of the Deputy Commissioner under this chapter may be taken in appeal to the Chief Controlling Revenue Authority within 60 days. Karnataka moved to digital e-stamps on the Kaveri system in 2025, so the sub-registrar's office should confirm how a digital stamp is surrendered. A copy of everything filed, with the acknowledgement, should be kept until the money is credited.

When the Builder Is at Fault

A buyer who withdraws from a project because of the developer's default has a second route. Section 18 of the RERA Act entitles that buyer to the amount paid with interest, and to compensation. Karnataka RERA has included stamp charges in such orders. In a refund order reported in January 2026 on a flat in Electronic City, the amount covered franking charges of Rs. 41,650 along with the price paid and interest.

The two routes work together. The stamp office refunds only what the Act allows, after the deduction, while the builder may be ordered to make good the full loss. A buyer who is close to a time limit should file the stamp refund application first and pursue the complaint alongside it. Our guide to cancelling a flat booking covers how much of the booking amount a builder may keep.

After a Sale Deed Is Registered

A registered sale deed transfers ownership, and the duty on it is spent. Buyer and seller who agree to undo the sale need a fresh deed that transfers the property back, with stamp duty and registration fee paid again. A sale that is disputed, for fraud or a defect in title, is set aside by a civil court, and the duty is not returned on that ground alone.

This is the reason to complete every check before the deed is presented. The title search, the loan sanction and the guidance value should all be settled while the document is still a draft. For help with the steps before registration on a home in Bangalore, write to our team.

Frequently Asked Questions

How much is deducted from a stamp duty refund?+
The Act deducts 20 paise per rupee for a spoiled stamp and 10 paise per rupee for an unused stamp. On Rs. 5 Lakhs of duty, the refund is Rs. 4 Lakhs or Rs. 4.5 Lakhs.
